Note: Interviews for Growing Forward were all conducted via Zoom as a part of our COVID-safe practices. Originally our plan was to do interviews in person, but in order to maintain social distancing and to keep everyone involved safe and healthy, we decided to use the technology available to us.

Hosts Andy Lyman and Megan Kamerick are joined by the creative team behind the podcast NM CannaCast to talk about the state of the cannabis industry in New Mexico just a little over one year after the passing of the Cannabis Regulation Act. The group talks about taxes, equity, finances and why there is still so much confusion out there about this industry.

Also in the episode, Host Andy Lyman mentions his recent article for New Mexico Political Report, dealing with the lack of education standards to date, something that was intended in the original Cannabis Regulation Act. Risks and Rewards of Getting Into Business With Cannabis | 5.31.22 Expand

The focus of this podcast has always been to take a look at recreational use cannabis as a legitimate business and industry. And the financial challenges are many. In our most recent episode (Season 4, Episode 5) we looked at the issues news businesses face securing loans and basic banking services when dealing with a product that is still considered federally illegal. We got a lot of response to that episode, and we want to share what we learned with you in this follow up. And for the most part, the news appears to be good for those trying to break into the industry in New Mexico. Hosts Andy Lyman and Megan Kamerick talk with Shannon Cox, Cannabis Program Executive with Southwest Capital Bank, about their ever-expanding approach to lending to cannabis businesses. We also learn more about risk management and insurance coverage for these businesses with Kenny Byrd, a risk Management Specialist. We even discuss workers compensation issues within this industry and what best practices seem to be when it comes to workplace accidents.

Getting into the legal recreational-use cannabis industry creates several unique challenges. Maybe none a bigger hurdle than securing financing. As we have touched on before in this podcast, banking options remain limited because of the federal status of cannabis. But that just scratches the surface of the potential financial stumbling blocks for new businesses. Factor in lawmakers’ desire to create opportunities for equity and diversity in the industry, and the challenge is clear. Cannabis Testing Takes Center Stage | 4.18.22 Expand

Now that legal recreational-use cannabis sales are up and running in New Mexico, the spotlight once again turns to the testing process. Co-host Andy Lyman has done a lot of great reporting on a testing dispute that has already made it into the New Mexico courts system. He and Megan Kamerick break down the debate, and summarize the court proceedings to date.

Then, the pair check back in with one of the only testing labs in New Mexico to find out if the owner is having any difficulties keeping up with demand, as well as the prospect of new testing labs coming online in the coming months.

The Curtain Comes Up on Legalized Recreational-Use Cannabis Sales in New Mexico | 4.5.22 Expand

The day many had been waiting for finally arrived on Friday, April 1st, 2022. That was the day legal recreational-use cannabis sales started in New Mexico, after the state legislature passed the Cannabis Regulation Act in 2021. According to Governor Michelle Lujan Grisham’s office, business was indeed booming over the inaugural weekend. The state reported 5.2 million dollars in sales through the first weekend. Three and a half million of that was recreational-use with another $1.7 million in medical cannabis sales.

“New Mexico was ready for this historic opportunity to end prohibition,” said Cannabis Control Division Director Kristen Thomson. “Whether it’s people moving from the illicit market to the safe, regulated legal market or brand-new customers excited to try high-quality New Mexico products for the first time, New Mexicans supported cannabis businesses in record numbers this weekend.”

“In every state that launched adult-use sales before New Mexico, some retailers sold out on opening day,” Thomson said. “In New Mexico, that was simply not the case. Customers and patients across the state were all able to get the products or medicine they wanted and needed. Through careful regulatory planning hand-in-hand with industry, New Mexico cannabis producers have done something that’s never been done before. This weekend’s successful launch is something we can all be proud of.”

Cannabis Clock Ticks Down, Plus the Science of a Plant | 3.22.22 Expand

The clock is ticking to the start of legal recreational-use cannabis sales in New Mexico. April 1st at noon is the first time people can buy cannabis without having a medical card. So, how ready is the state for this new industry? We check in with Kristen Thomson, Director of the New Mexico Cannabis Control Division, to find out. Specifically, the Growing Forward team wants to know if there is concern about a shortage of supply, given the aggressive timeline for this rollout. In addition, lawmakers failed to make an adjustment to the Cannabis Regulation Act during the recent regular legislative session.

We also find out the role social media like TikTok and Instagram is having in educating people about the science of cannabis. Riley Kirk is very active on both platforms and also co-hosts a podcast with Dr. Miyabe Shields called Smoke ‘n Science. Kirk helps explain some of interesting new research about the possibility that cannabis could ward off COVID-19. But, she also explains the differences between smoking cannabis, and using other types of the plant like vapes, edibles and tinctures.

Season 3

New Cannabis Control Division Director, Water Rights and a Wrap on Season 3 | 12.21.21 Expand

This week, we wrap up Season 3 of the podcast with a grab bag of topics. For starters, we introduce you to the state’s first ever Director of the Cannabis Control Division. Kristen Thomson has spent years in the industry, mostly in Colorado, as a lobbyist. Hosts Andy Lyman and Megan Kamerick find out why she wanted to take on this job, and how she will avoid any potential conflicts of interest from her previous work.

In addition, we get to the bottom of some of the lingering questions about water and cannabis, with John Romero of the Water Resource Allocation Program.  They also discuss what we know about our water outlook and how a new cannabis industry might affect our ongoing drought.

Andy and Megan also break down some of the most recent headlines on cannabis, including Bernalillo County’s decision to ban indoor consumption areas once the recreational-use market is up and running. What’s the Deal with Automatic Expungements? | 11.22.21 Expand There was big news this week on the cannabis front in New Mexico. As our co-host, Andy Lyman first reported, the state has now issued its first cultivation license. This is no doubt a big step for the recreational market in New Mexico, but it still leaves countless other applications in limbo with time running out to get plants in the ground in time for the first day of legal sales on April 1, 2022.  A big part of the push to create a legal cannabis industry in New Mexico was the idea of automatic expungements for those with past cannabis-related convictions or arrests. The idea is simple, to try and undo some of the wrongs inflicted on especially people of color during the longstanding war on drugs. But, what does “automatic” really mean? Time Crunch Looms, Carbon Footprint and Mysterious Medical License Drama | 11.9.21 Expand

The clock is ticking down for people hoping to break into the state’s forthcoming recreational cannabis market. Would-be producers are still weaving their way through the licensing process, and that path has been anything but smooth so far. This week, we talk to three different business owners, who all share similar frustrations about navigating the licensing process with the Regulation and Licensing Department and various municipal governments. Once those businesses have their licenses, those business owners can begin the process of growing and cultivating. But, unless those pieces are all in place soon, the chances they can have product ready for the market by next April 1st, when the recreational market kicks off, is very much in doubt. Read more about their concerns about the state’s aggressive timeline, in a recent report from co-host Andy Lyman at NM Political Report.

Water has been another constant concern and theme of this new industry, as it is with all agricultural businesses in New Mexico. But, what about the other environmental impacts of growing cannabis? Researchers at Colorado State University join Andy and Megan to discuss their research about the carbon footprint of this new crop, especially in terms of indoor grows.

Lastly, Megan talks with Andy about his latest report for NM Political Report, just published this morning. It examines the strange case of a solitary medical cannabis license which was granted just a day before the cannabis program shifted from the New Mexico Department of Health to the Regulation and Licensing Department. There are plenty of questions about the process used, and the business owner who got that single license, but there is no doubt, given the backlog in processing new licenses for the recreational market, that this gives Vance Dugger a clear advantage headed into 2022.

What to do With Cannabis Consumption Areas? | 10.26.21 Expand

The idea of consumption areas have been a potential under New Mexico’s medical cannabis program for a while, but the state has yet to see a single designated consumption site set up. Part of that has to do with the COVID-19 pandemic, but could it also have something to do with confusion over exactly what constitutes a consumption area, and what the license requirements will be? These are important questions, especially as these unique locations take on a higher profile under the state’s new recreational cannabis market. This week on the podcast, we learn more about the  history of consumption areas, and the questions left to be answered as the state sets up rules and gets ready to accept applications for consumption area licenses.

In this episode, you will also hear mentioned that the Cannabis Control Division is holding this Thursday, October 28th. Regulation and Licensing, which operates the Cannabis Control Division, will be meeting to discuss licensing requirements for manufacturer, retail and courier licensing. Did you know that in some circles, we’re closing in on the season known as ‘Croptober’? Seems like the perfect time to really dive into the ins and outs of growing cannabis. This week, we kick things off with advice and insights from a man who knows a thing or two about growing crops. Dave Dewitt is a food historian, novelist and the self-proclaimed “Pope of Peppers.” Many in New Mexico also remember him as the man behind the Fiery Foods Show. He joins New Mexico in Focus Correspondent Gwyneth Doland about why part of his green thumb also extends to growing medical cannabis, something he’s been doing for quite a while now.

The growing will have to wait a while longer for some folks aiming to get a production license under the new Cannabis Control Act. We caught up with one business that is still trying to get their license from the Cannabis Control Division, but as you will hear, it’s anything but simple. Those would-be producers have to secure that license before they can begin growing, which means the clock is ticking if they’re going to have merchandise available when the legal market kicks off on April 1st, 2022.

Meet the Cannabis Regulatory Advisory Committee | 9.14.21 Expand

Part of the Cannabis Control Act, passed by the New Mexico Legislature during a 2021 Special Session, included the creation of a Regulatory Advisory Committee. The group is a cross section of people with expertise or interest in this new industry, but none of the members can have direct financial interests in that industry. The 17-person panel has now been named, and already conducted its first meeting. The group will be meeting again later this month, as they offer insight and suggestions for the Regulation and Licensing Department, which is tasked with overseeing the industry. This week, we meet three members of the Committee and learn more about their specific roles and responsibility, including the equity goals set out in the Cannabis Control Act.

The New Mexico Cannabis Control Division has officially started accepting cannabis cultivation license applications, after finalizing the industry rules for that segment of the industry. Already more than 400 applications have been filed. Learn more about that in co-host Andy Lyman’s latest report for New Mexico Political Report. Now, the attention turns to some of the other aspects of creating a cannabis industry, including the education and training requirements. In this episode, we sit down with Shannon Jaramillo of SeedCrest LLC. Shannon has joined us before, as she continues to work of creating curriculums for colleges and universities across New Mexico. Shannon discusses what she rules she would like to see for training in the cannabis realm, as well as what kind of students she is attracting into her classrooms.

Testing Lab Field Trip | 8.17.21 Expand

Testing will be an integral part of the new recreational cannabis industry in New Mexico. But, it hasn’t received a lot of attention so far. In fact, the state is largely in limbo right now when it comes to testing standards. The last attempt at updating cannabis testing rules promulgated by the state Department of Health, for medical cannabis, was essentially shot down by a state court judge. There are still old testing standards from the Department of Health, but the Regulation and Licensing Department has yet to issue rules for non-medical cannabis testing. Co-hosts Megan Kamerick and Andy Lyman visit a testing lab in Albuquerque, to find out more about the process, why those testing standards are so important, and why no one seems sure right now just how many testing labs the state will need moving forward.

The excitement about a new cannabis industry in New Mexico is palpable, as we learned in our last episode of “Growing Forward.” But, the questions about how it will all work as just as plentiful. Regulators, vendors and potential customers got a chance to mingle and share information at the Albuquerque Convention Center.

Season 2

Talking Taxes with Richard Anklam | 5.24.21 Expand

We join you for a special update, with information about court action involving taxes and medical cannabis sales. Our co-host Andy Lyman has the very latest on New Mexico Political Report, but basically a decision is now in the hands of the State Supreme Court on the issue of whether taxes on medical cannabis sales should have been deductible prior to this year.

Today, all eyes will be on the Cannabis Control Division website, as the first proposed rules are released for cannabis producers. There’s still a lot of other work going on as well, but folks will now have the first chance to see what the state is thinking in terms of setting up this industry in New Mexico. We’ll have much more on these proposed rules in the very near future.

Also in this episode, we welcome Richard Anklam of the Tax Research Institute, to talk more about the tax issues circling around a legalized market.

Cannabis Comes Full Circle for Former Gov. Gary Johnson | 4.5.21 Expand

Former New Mexico Governor Gary Johnson made national headlines back in the 90s by publicly advocating for the legalization of adult use cannabis. His comments were made years before the state even set up a medical cannabis program. And still today, it is one of the top things that Johnson is known for, both here in New Mexico and nationally. In a special episode of Growing Forward, co-hosts Andy Lyman and Megan Kamerick catch up with Governor Johnson to get his reaction to the New Mexico legislature’s historic vote last week, sending an adult use legalization bill to the Governor’s desk, along with a companion bill creating a process for the expungement of cannabis-related offenses. After a two-day special session, lawmakers approved the cannabis regulation bill – HB 2 – which now heads to the Governor’s desk for her signature. Special Session Day 2 Recap | 3.31.21 Expand

Another busy day in the Roundhouse, as lawmakers once again took up the legalization of adult use cannabis in New Mexico. At the time the Growing Forward team recorded this update, much of the work had been completed, and just minutes after we finished recording the Senate passed House Bill 2 the Cannabis Regulation Act by a vote of 22 to 15.  The House concurred with the changes just a few minutes after that, so the measure is headed to the Governor’s desk, along with Senate Bill 2, which creates automatic expungements for cannabis related offenses, as well as Senate Bill 1 which made changes to the Local Economic Development Act, or LEDA. Read more on the completion of this Special Session, from co-host Andy Lyman at New Mexico Political Report.

Special Session Day 1 Recap | 3.30.21 Expand

Day one of the 2021 Special Legislative Session saw several proposals introduced dealing with the legalization of adult use cannabis in New Mexico. There are competing bills in the House and Senate, known as the Cannabis Regulation Act (in the House it is House Bill 2, and in the Senate, Senate Bill 3). Both are being treated very differently, with HB 2 getting two committee assignments and SB 3 being sent straight to the Senate Floor. There is also a separate bill, Senate Bill 2, which deals with expungement of some cannabis-related crimes, if SB 3 or HB 2 were to pass. And, there are also pieces of the cannabis legalization in the so-called Feed Bill, House Bill 1. Additional appropriations were included to pay for aspects of running the legal cannabis market, again should HB 2 or SB 3 pass. That led to a lot of debate about whether or not it was right to be discussing these things before a legal market is even approved.

This week, we want to share some of the great work from our colleagues over at KUNM Radio, where co-host Megan Kamerick also works as an on-air host. Cannabis Education Efforts | 2.3.21 Expand

If lawmakers approve the legalization of recreational cannabis in this year’s legislative session, the issue of education and training for industry workers and medical professionals will be a top priority. This week on “Growing Forward” we dive back into this important issue. Hosts Andy Lyman (New Mexico Political Report) and Megan Kamerick (NMPBS & KUNM) talk with Shannon Jaramillo, cannabis educator and founder of Seed Crest. Jaramillo has worked with Northern New Mexico College to set up an accredited cannabis education program. New Mexico Senate Majority Leader Senator Wirth on 2021 Legislative Session & Cannabis Legalization | 1.24.21 Expand

We kick off season 2 of “Growing Forward” where we left off with season 1: the 2021 Legislative Session. The Legislature convened on Tuesday, January 19th to kick off the 60-day session, which will be unlike any of us we have ever experienced before. Because of the ongoing COVID-19 pandemic, lawmakers will do their work mostly remotely and the public is not allowed into the Roundhouse at all this year. There is still a lot of uncertainty about just how the peoples’ work will get done over the next two months, but one thing we know is that legalizing recreational cannabis will be debated and discussed. We wanted to get a better idea of how supporters plan to attack the issue this session, so hosts Andy Lyman and Megan Kamerick sat down on zoom with Senate Majority Leader Peter Wirth (D). Cannabis and Indigenous Communities | 11.17.20 Expand A missing piece of most cannabis conversations in New Mexico, whether it has to do with medical or the potential for legalization of recreational- use, is how Indigenous Communities are impacted. It’s a complicated scenario, especially when you consider the 23 Tribes in our state are all sovereign nations. This week on “Growing Forward” we dive into those sovereignty issues, and how Indigenous communities perceive the future of cannabis in their communities.

The clock is officially ticking, if New Mexico wants to legalize recreational-use cannabis. That’s because voters in Arizona approved a measure last week, legalizing the drug in another neighboring state. Lawmakers and Governor Michelle Lujan Grisham will no doubt make it a top priority for the 2021 session, but there are many questions still to be answered as the legislation is drafted. The debate over medical cannabis use in New Mexico goes back to the 1970s. But it really cranked up in the 1990s, when former Governor Gary Johnson came out in support of legalization and decriminalization. It was a controversial stance at the time, but was coupled by the early stages of a push for legislation creating a medical cannabis program. That debate would last for nearly a decade, but the Lynn and Erin Compassionate Use Act was signed into law in 2007. In this episode of “Growing Forward” we look back at that time and talk to lawmakers and advocates who worked tirelessly to create the nation’s 13th medical cannabis program.
