A bill moving through the state Legislature would make it the law.<\/p>\n<p>The proposal (<a href=\"http:\/\/www.nmlegis.gov\/Sessions\/15%20Regular\/bills\/house\/HB0378.pdf\">HB 378<\/a>), sponsored by state Rep. James E. Smith, R-Sandia Park, and Sen. Daniel A. Ivey- Soto, D- Albuquerque, adds one sentence to the Open Meetings Act: \u201cA public body shall provide an opportunity for oral public comment on matters within the authority of the public body.&#8221;<\/p>\n<p>The\u00a0<a href=\"http:\/\/nmfog.org\/\">New Mexico Foundation for Open Government<\/a>\u00a0is behind the bill.<\/p>\n<p>\u201cWe really don\u2019t have a democracy if we\u2019re not allowed to say things that are contrary to the actions of our elected officials,\u201d Executive Director Susan Boe said Monday. \u201cWe really need to welcome this messiness that we call democracy.\u201d<\/p>\n<p>Critics of the bill are concerned that allowing public comment periods may take up too much time and perhaps even require them to meet more often.<\/p>\n<p>But the current wording is a compromise that gives officials leeway to determine how long the comment period will be, how long each person will be able to talk\u2014and how often the comment period will be offered, Boe said.<\/p>\n<p>Although the state Open Meetings Act dictates that \u201call persons desiring shall be permitted to attend and listen to the deliberations and proceedings,\u201d it doesn\u2019t require the government to allow members of the public to share their opinions on the matters at hand.<\/p>\n<p>Several public bodies have tried to limit public input by banning criticism or negative comments altogether. When the Village of Ruidoso created a policy than banned \u201cany negative mention . . . of any Village personnel, staff, or of the Governing Body\u201d in public comments, a federal court\u00a0<a href=\"http:\/\/nmfog.org\/files\/2014\/09\/Griffin-v.-Village-of-Ruidoso-MRH.pdf\">declared the policy<\/a>\u00a0an unconstitutional restriction of free speech because it allowed praise but not criticism.<\/p>\n<p>Another\u00a0<a href=\"http:\/\/nmfog.org\/files\/2014\/09\/MacQuigg-v.-APS-3.31.14.pdf\">recent court decision<\/a>\u00a0reprimanded an effort by the Albuquerque Public Schools Board of Education to limit the speech of a persistent gadfly\u2014but also pointed out the gap in the law, noting \u201cthe Legislature has not designated public meetings as public forums for speech or debate by attendees.\u201d<\/p>\n<p>The discussion of public meetings comes during\u00a0<a href=\"http:\/\/www.sunshineweek.org\/\">Sunshine Week<\/a>, a national initiative to promote dialogue on the importance of open government and freedom of information.<\/p>\n<p>The House is expected to vote on the bill early this week.
