He <a href=\"https:\/\/nmindepth.com\/2026\/after-exiting-the-democratic-party-former-las-cruces-mayor-makes-his-case-as-an-independent\/\">hopes<\/a> to get on the fall ballot as an independent.<\/p>\n\n\n\n<p>When asked about it, Miyagishima said he received guidance from a staff member of the Secretary of State (SOS) that made him believe the amounts were allowed. In-kind contributions are goods or services provided to a candidate, rather than monetary donations. Emails provided by Miyagishima to New Mexico In Depth appear to show a state elections official telling Miyagishima he was \u201creading the website correctly\u201d in response to a question from Miyagishima that asked whether in-kind contributions from businesses or persons were unlimited.<\/p>\n\n\n\n<p>But state law requires campaigns to count the value of non-monetary support from individuals or businesses toward contribution caps, which for the 2026 governor\u2019s race are set at $24,800 per donor. That includes $12,400 for the primary and $12,400 for the general election. Multiple companies gave Miyagishima in-kind donations valued more than those limits last year.<\/p>\n\n\n\n<p>The donations are reported on his <a href=\"https:\/\/login.cfis.sos.state.nm.us\/\/ReportsOutput\/\/103\/5749c33c-a4f8-4210-82b3-23346f9781f8.pdf\">first campaign finance filing last October<\/a>. It is unclear how much additional in-kind support the campaign has accepted since then; his next disclosure report is due in April.<\/p>\n\n\n\n<p>Miyagishima provided New Mexico In Depth with a series of emails between himself and Charles Romero, Elections Deputy Director for the Secretary of State\u2019s office, when the news organization asked him why his in-kind donations exceeded the legal limit.<\/p>\n\n\n\n<p>New Mexico In Depth has not independently obtained the emails in order to verify that the email thread is complete and accurate. But the emails reflect a back-and-forth conversation between Miyagishima and Romero over a month, just as Miyagishima prepared to kick off his campaign last May.<\/p>\n\n\n\n<p>In April 2025, Miyagishima sent an email asking about the state\u2019s contribution limits. The following day, Romero notified the candidate that the Secretary of State\u2019s office had updated a contribution limits table on its website, effective Jan. 1, 2025, and provided Miyagishima with a link to the webpage.<\/p>\n\n\n\n<p>Later in May, Miyagishima replied to Romero with a screenshot of a portion of the campaign contributions limits table from the SOS website that depicts, in part, the words \u201cno limits on in-kind.\u201d On the website, those words are in a column labeled \u201cLCC\u201d regarding contributions made by Legislative Caucus Committees. LCCs are special committees from each political party in the Legislature. These committees have higher contribution limits and allow unlimited in-kind contributions to candidates of the respective party.<\/p>\n\n\n\n<p>Along with the screenshot, Miyagishima asked Romero about the in-kind limits more broadly. He received $37,500 from Jolly Rodgers Software for computer work and social media consulting, and $33,000 from TTG Inc for consulting. And his own insurance company provided $52,594. Taken together, the portions of each company\u2019s donations that exceeded legal limits total $125,644.<\/p>\n\n\n\n<p>Secretary of State spokesperson Lindsey Bachman confirmed that the value of in-kind contributions falls under the same contribution limits as money. Candidates must add all of their contributions from one donor together and remain under the limits. Bachman also clarified that the limits apply to companies owned by candidates, as well, while there are no limits on their own personal funds.<\/p>\n\n\n\n<p>As to whether the office gave Miyagishima bad advice, Bachman consulted with Romero and then replied in an email, \u201cThere has been confusion it appears\u2026In the thread below, it seems like a couple of questions were submitted in succession from the candidate.
