(Courtesy of Environmental Protection Agency)<\/figcaption><\/figure>\n\n\n\n<div class=\"wp-block-columns is-layout-flex wp-container-core-columns-is-layout-9d6595d7 wp-block-columns-is-layout-flex\">\n<div class=\"wp-block-column is-layout-flow wp-block-column-is-layout-flow\" style=\"flex-basis:100%\"><\/div>\n<\/div>\n\n\n\n<p>Billing problems, dry taps and excessively leaky pipes paint a picture of a rural water utility that is \u201cbarely limping along\u201d and may need state intervention, one of New Mexico\u2019s three Public Regulation Commission members said at a recent meeting.<\/p>\n\n\n\n<p>Commissioner Patrick O\u2019Connell was responding to a complaint filed in January by Timberon resident and former Timberon Water and Sanitation District Board Member Mark Harding.<\/p>\n\n\n\n<p>Timberon, a town of fewer than 1,000 people, lies in Otero County and is nestled between Alamogordo and Pi\u00f1on at the southern edge of the Lincoln National Forest.<\/p>\n\n\n\n<p>Harding accused the Timberon utility of overbilling customers and inconsistently applying taxes to customer bills. In subsequent filings with the PRC, he alleged that utility staffers and elected board members incited community members to attack him on social media by making light of his complaint at recent board meetings and on social media. One resident on Facebook referred to his complaint against the utility as evidence that \u201cSatan is at work\u201d in the community.<\/p>\n\n\n\n<p>Harding\u2019s complaint also drew attention to bigger issues of water quality and reliability in the small town.<\/p>\n\n\n\n<p>Public notices show that the Timberon Water and Sanitation District recently violated multiple state water quality requirements. One such <a href=\"https:\/\/www.timberonwater.com\/files\/8a7b22b04\/Morvs_TWSD-violations-Feb2025.pdf\">notice<\/a>, posted in February, revealed violations for monthly reporting requirements and for failing monthly water disinfection requirements. Tests at the time found bacteria in the water \u2014 water district officials responded and said they were addressing the issue by putting chlorine in the water, per state guidelines.<\/p>\n\n\n\n<p>More recent public <a href=\"https:\/\/www.timberonwater.com\/files\/0e4210d2a\/PRECAUTIONARY+BOIL+WATER+ADVISORY_Nov-18-2025.pdf\">notices<\/a> reveal that in November officials put residents on a \u201cprecautionary water boil advisory.\u201d Customers reported low pressure in their water, the notice said, which \u201cmay increase the likelihood of microbiological contamination within the distribution system.\u201d It warned residents, in an all-caps message, \u201cDO NOT DRINK THE WATER WITHOUT BOILING IT FIRST.\u201d<\/p>\n\n\n\n<p>During a late November PRC hearing about Hardin\u2019s complaint, O\u2019Connell said he thought commissioners needed to consider receivership, \u201cbecause this utility is not functioning.\u201d<\/p>\n\n\n\n<p>\u201cHow many more Timberon issues do we need to see before we put the pieces together and say, \u2018We need a bigger solution than a fine,\u2019\u201d he said. \u201cIf the community won\u2019t create the solution themselves, which would be my preference, then we might need to take all of what\u2019s going on down there as a sign to regulate more assertively.\u201d<\/p>\n\n\n\n<p>David Cruey, the Timberon Water and Sanitation District\u2019s governing board chair, told Source NM that he was not aware of O\u2019Connell\u2019s comments until a reporter called him. He said TWSD officials are working with their delegation in the state Legislature to obtain the funding they need to update the system\u2019s aging water infrastructure. Source NM contacted Rep. Harlan Vincent (R-Ruidoso Downs), but he did not respond to requests for comment.<\/p>\n\n\n\n<p>\u201cA receivership wouldn\u2019t help us. What we need is $45 million to $50 million to overhaul our water system,\u201d he said. \u201cA receivership is not going to bring money in, that\u2019s for sure.\u201d<\/p>\n\n\n\n<p>According to Cruey, the water system in the area was installed in the 1970s and hasn\u2019t been upgraded much since then. \u201cIt was subpar then and it\u2019s certainly subpar now,\u201d he said.<\/p>\n\n\n\n<p>Harding\u2019s case and the longstanding issues of reliability and safety highlight the ongoing struggles of other small-town utilities across the state \u2014 earlier this year, the New Mexico Environment Department <a href=\"https:\/\/sourcenm.com\/briefs\/nm-environment-department-sues-crrua-water-system\/\">sued<\/a> the Camino Real Regional Utility Authority in Sunland Park over longstanding problems with reliability and exceedingly high levels of harmful contaminants such as arsenic. In court, NMED officials asked a judge to place the utility in a receivership. And in a hearing before state lawmakers in November, a coalition of New Mexico locales said they <a href=\"https:\/\/sourcenm.com\/2025\/11\/18\/coalition-of-nm-locales-says-200-million-more-needed-for-water-projects\/\">need<\/a> an extra $200 million to fully fund water infrastructure projects across the state.<\/p>\n\n\n\n<p>In addition to its other issues, Timberon loses as much as 85% of the town\u2019s water due to leaky pipes, O\u2019Connell said at the November meeting. Harding shares his concern.<\/p>\n\n\n\n<p>\u201cWe lose 3.5 million gallons a month to water loss,\u201d Harding said. \u201cMy concern is that it\u2019s not an infinite supply.
