Credit: Bella Davis\/New Mexico In Depth<\/figcaption><\/figure>\n\n\n\n<div class=\"wp-block-columns is-layout-flex wp-container-core-columns-is-layout-9d6595d7 wp-block-columns-is-layout-flex\">\n<div class=\"wp-block-column is-layout-flow wp-block-column-is-layout-flow\" style=\"flex-basis:100%\"><\/div>\n<\/div>\n\n\n\n<p>The Public Education Department\u2019s court-ordered plan to improve education for public school students across New Mexico lacks robust community oversight and targeted investments, advocates and educators say.<\/p>\n\n\n\n<p>Those are some initial reactions shared at a press conference Wednesday in Albuquerque to the <a href=\"https:\/\/web.ped.nm.gov\/wp-content\/uploads\/2025\/11\/NM-Martinez-Yazzie-Action-Plan_11.3.25.pdf\">190-page plan<\/a> released this week.<\/p>\n\n\n\n<p>In April, a state judge found New Mexico wasn\u2019t complying with a landmark 2018 ruling, known as Yazzie\/Martinez for its lead plaintiffs, that directed the state to meet its constitutional duty to sufficiently educate Native American students, English language learners, low-income students, and students with disabilities.<\/p>\n\n\n\n<p>The education department was ordered to provide a draft plan by October.<\/p>\n\n\n\n<p>After a series of <a href=\"https:\/\/nmindepth.com\/2025\/native-communities-urge-state-to-embrace-language-culture-in-yazzie-martinez-plan\/\">public meetings<\/a>, the department met the deadline and asked for feedback on the draft. Indigenous education experts and <a href=\"https:\/\/sourcenm.com\/2025\/10\/07\/plaintiffs-criticize-remedial-draft-plan-in-yazzie-martinez-case-as-too-vague\/\">other advocates<\/a> said it was <a href=\"https:\/\/nmindepth.com\/2025\/yazzie-martinez-draft-plan-angers-indigenous-education-experts-and-advocates\/\">lacking in detail<\/a>, with Melissa Candelaria (San Felipe Pueblo), education director at the New Mexico Center on Law and Poverty and attorney for the Yazzie plaintiffs, calling it \u201cdismal.\u201d<\/p>\n\n\n\n<p>The agency\u2019s latest version was delivered Monday. Plaintiffs have until Dec. 1 to file objections in court.<\/p>\n\n\n\n<p>In a Tuesday press release, Public Education Secretary Mariana Padilla wrote, \u201cWe listened to what communities told us they need, and this plan reflects those priorities. Every student deserves access to quality education that respects their culture and language.\u201d<\/p>\n\n\n\n<p>But while some proposals in the plan \u201cuse the language of equity,\u201d said Loretta Trujillo, executive director of Transform Education NM, \u201cthey keep control and resources exactly where they\u2019ve always been\u201d instead of giving greater power to communities and tribal governments.<\/p>\n\n\n\n<p>The plan adds more detail to a section about culturally and linguistically responsive education \u2014 teaching that integrates students\u2019 cultures, experiences and languages \u2014 but it oversimplifies what that requires, speakers on Wednesday said.<\/p>\n\n\n\n<p>\u201cThe final plan suggests that giving teachers high quality textbooks is the same as giving students culturally and linguistically responsive teaching \u2026 It is not the same,\u201d said Travis McKenzie, a teacher at Polk Middle School in Albuquerque\u2019s South Valley. \u201cStudents need teaching rooted in who they are, teaching and curriculum that honors their cultural heritage, that honors their diverse walks of life, and allows them to see themselves in the content that we teach.\u201d<\/p>\n\n\n\n<p>To that end, he said, one of his school\u2019s focuses is <a href=\"https:\/\/nmindepth.com\/2025\/indigenous-farm-connecting-young-people-with-land-boosting-local-food-access\/\">outdoor learning<\/a>.<\/p>\n\n\n\n<p>Laurel Nesbitt, senior attorney for Disability Rights New Mexico, said one \u201cencouraging aspect\u201d of the plan is that it acknowledges the need for more academic and behavioral support for students with disabilities, who are disproportionately suspended and the subjects of law enforcement calls.<\/p>\n\n\n\n<p>The plan proposes training for educators that would cut down on those practices and create safer environments for learning. But instead of simply offering training, the state should require that all educators and administrators receive it, Nesbitt said.<\/p>\n\n\n\n<p>Speakers at Wednesday\u2019s event, hosted at the New Mexico Black Leadership Council\u2019s headquarters, said although Black students aren\u2019t one of the four student groups identified in the lawsuit, the plan also needs to include them. Since the 2018 ruling, New Mexico has passed the Black Education Act, which mandates, among other things, anti-racism trainings for school staff.<\/p>\n\n\n\n<p>\u201cBlack students experience lower expectations, harsher discipline and fewer opportunities for advanced coursework and enrichment,\u201d said state Rep.
