It wasn\u2019t. As a result, three people arrested in recent weeks won\u2019t face <a href=\"https:\/\/corpuslegalis.com\/us\/code\/title50\/penalty-for-violation-of-security-regulations-and-orders\">newly created criminal charges<\/a> for trespassing on a military base, punishable by up to a year in jail.<\/p>\n\n\n\n<p>The dropped charges point to the ongoing confusion the <a href=\"https:\/\/sourcenm.com\/briefs\/by-the-s-nms-new-military-controlled-border-zone-is-not-a-60-foot-buffer-its-400-square-miles\/\">new 400-square-mile military zone<\/a> has created across branches of government and the courts since the U.S. Interior Department <a href=\"https:\/\/sourcenm.com\/briefs\/u-s-interior-transfer-land-on-nm-border-to-army\/\">transferred the land to the Army in April<\/a>.<\/p>\n\n\n\n<p>\u201cIt is concerning that even the Acting United States Attorney is confused by the boundaries of this new National Defense Area,\u201d a spokesperson for U.S. Sen. Martin Heinrich (D-NM) said in an emailed statement Thursday after Source New Mexico alerted his office to the dismissals. Heinrich has criticized the new NDA and called on the Defense Department to <a href=\"https:\/\/sourcenm.com\/briefs\/heinrich-pushes-defense-secretary-hegseth-for-answers-on-nms-new-military-zone\/\">explain<\/a> what it means for recreators and others.<\/p>\n\n\n\n<p>On April 15, Defense Secretary Pete <a href=\"https:\/\/www.defense.gov\/News\/News-Stories\/Article\/Article\/4156956\/interagency-land-agreement-strengthens-military-border-mission\/\">Hegseth<\/a> and Interior Secretary Doug Burgum <a href=\"https:\/\/www.blm.gov\/press-release\/secretary-interior-transfers-federal-lands-along-new-mexico-border-army-protect\">announced<\/a> the transfer of land from the Bureau of Land Management to the military, effectively making the 180-mile border New Mexico shares with Mexico into an extended military base tied to Fort Huachuca in Arizona.<\/p>\n\n\n\n<p>Along with increasing Army patrols and empowering the \u201cmilitary [to] take a more direct role in securing our southern border,\u201d as President Donald Trump <a href=\"https:\/\/www.defense.gov\/News\/News-Stories\/Article\/Article\/4156956\/interagency-land-agreement-strengthens-military-border-mission\/\">said<\/a>, creating the zone also enabled federal prosecutors to impose misdemeanor charges on those caught in the new National Defense Area.<\/p>\n\n\n\n<p>Confusion about where that area falls exists not just among federal agencies tasked with enforcing the NDA, but also among residents who live, work and attend school along the border, including ranchers with BLM cattle leases and dual citizens who cross the border daily.<\/p>\n\n\n\n<p>Source NM spent the weekend in the area and talked with residents who described whiplash from a transfer, seemingly overnight, of federal public lands into an extended military base.<\/p>\n\n\n\n<p>The land includes parcels of private property surrounded by federal lands; the Diocese of El Paso, which owns nearby pilgrimage site Mount Cristo Rey; and the State of New Mexico, which has miles of trust land.<\/p>\n\n\n\n<figure class=\"wp-block-image size-large\"><img loading=\"lazy\" decoding=\"async\" width=\"1024\" height=\"576\" src=\"https:\/\/www.newmexicopbs.org\/productions\/newmexicoinfocus\/wp-content\/uploads\/2025\/06\/Angel-Pena-1024x576.jpg\" alt=\"A person sits in the driver's seat of a vehicle parked in a desert area, looking out the window at the dry landscape and clear sky.\" class=\"wp-image-47154\" srcset=\"https:\/\/www.newmexicopbs.org\/productions\/newmexicoinfocus\/wp-content\/uploads\/2025\/06\/Angel-Pena-1024x576.jpg 1024w, https:\/\/www.newmexicopbs.org\/productions\/newmexicoinfocus\/wp-content\/uploads\/2025\/06\/Angel-Pena-300x169.jpg 300w, https:\/\/www.newmexicopbs.org\/productions\/newmexicoinfocus\/wp-content\/uploads\/2025\/06\/Angel-Pena-1536x864.jpg 1536w, https:\/\/www.newmexicopbs.org\/productions\/newmexicoinfocus\/wp-content\/uploads\/2025\/06\/Angel-Pena-24x14.jpg 24w, https:\/\/www.newmexicopbs.org\/productions\/newmexicoinfocus\/wp-content\/uploads\/2025\/06\/Angel-Pena-36x20.jpg 36w, https:\/\/www.newmexicopbs.org\/productions\/newmexicoinfocus\/wp-content\/uploads\/2025\/06\/Angel-Pena-48x27.jpg 48w, https:\/\/www.newmexicopbs.org\/productions\/newmexicoinfocus\/wp-content\/uploads\/2025\/06\/Angel-Pena.jpg 1920w\" sizes=\"auto, (max-width: 1024px) 100vw, 1024px\" \/><figcaption class=\"wp-element-caption\"> Angel Pe\u00f1a looks out at the National Defense Area on Sunday. (Photo by Patrick Lohmann\/ Source NM)<\/figcaption><\/figure>\n\n\n\n<p>The land also traverses the Continental Divide Trail, and hosts both hikers on multi-state sojourns and hunters hoping to nab a rare Mearns quail, among heartier fare that hide among the creosote dotting the borderlands separating New Mexico from Mexico.<\/p>\n\n\n\n<p>Recently, the Defense Department issued a <a href=\"https:\/\/www.usatoday.com\/story\/news\/nation\/2025\/05\/17\/border-hunting-restricted-national-defense-area\/83653670007\/\">statement<\/a> telling hikers and hunters they were prohibited from entering the NDA. That incensed Angel Pe\u00f1a, director of Nuestra Tierra Conservation Project, a Las Cruces-based nonprofit that tries to help marginalized communities experience and conserve public lands.<\/p>\n\n\n\n<p>\u201cYou\u2019re really now affecting livelihoods,\u201d Pe\u00f1a told Source New Mexico during a drive Memorial Day Weekend along the northern edge of the NDA. \u201cYou\u2019re affecting dinner on the table. You\u2019re affecting recreation. You\u2019re affecting the traditional uses of this land that help families make memories and tell stories and grow ever closer.\u201d<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">No man\u2019s land<\/h2>\n\n\n\n<p>Between April 15 and May 29, the federal government charged more than 550 people with unauthorized entry into the new National Defense Area, according to a review of federal records.<\/p>\n\n\n\n<p>Federal prosecutors dropped charges for three of them based on the errant arrests dropped May 22, per Ellison\u2019s filings. According to court records, Ellison\u2019s office learned \u201con or about May 15\u201d that portions of the border area \u201cpreviously understood as encompassed\u201d by the newly created New Mexico National Defense Area \u201cwere not, in fact, transferred to the jurisdiction of the Army.\u201d<\/p>\n\n\n\n<p>The dismissed cases come amid ongoing legal challenges, with federal public defenders contesting the charges on a variety of fronts. Two weeks ago, a federal judge dismissed more than <a href=\"https:\/\/sourcenm.com\/2025\/05\/15\/federal-judge-dismisses-trespass-charges-against-migrants-caught-in-nm-military-zone\/\">100 charges<\/a> against the defendants, largely because he was not convinced those arrested knew they were entering a restricted area.<\/p>\n\n\n\n<p>The circumstances of the recent dismissals regarding errant arrests are not clear. AUSA spokesperson Tessa Duberry declined to comment on where the defendants were arrested, saying the office can\u2019t comment beyond what was filed publicly.<\/p>\n\n\n\n<p>She also declined to say how many total cases the office has dismissed on those grounds or would dismiss, saying compiling that information would impose a \u201csignificant burden\u201d on staff.<\/p>\n\n\n\n<p>Duberry referred comment about arrests to the Army, which told Source in a statement Friday morning that it would not speculate on charges that are awaiting adjudication,\u201d said Joint Task Force Southern Border spokesperson Jordan Beagle. (Photo by Patrick Lohmann \/ Source NM)<\/figcaption><\/figure>\n\n\n\n<p>\u201cThe Joint Task Force Southern Border remains laser focused on our mission to achieve 100% operational control of the border, in this case maintaining security within the National Defense Areas,\u201d he said, \u201cwhich includes detection, temporary detainment, and apprehension of those who trespass within the National Defense Areas.\u201d<\/p>\n\n\n\n<p>The Border Patrol did not respond to a request for comment from Source on Thursday.<\/p>\n\n\n\n<p>According to court filings, two of the three people feds dropped charges againt were arrested April 26 about \u201cfour miles east of the Santa Teresa Port of Entry.\u201d Outside of the 60-foot buffer zone along the border, that\u2019s roughly a mile from Mount Cristo Rey and other privately owned land. Source\u2019s calls to the Diocese this week were not returned.<\/p>\n\n\n\n<p>The third arrest occurred April 27, according to court filings, \u201cabout eight miles west of the Santa Teresa Port of Entry.\u201d<\/p>\n\n\n\n<p>All three criminal complaints note, as part of the justification for charges, that signs were posted in English and Spanish that \u201cthis is a restricted area and that unauthorized entry is prohibited.\u201d<\/p>\n\n\n\n<p>The impact of those dismissals on prosecutors\u2019 cases remains unclear. (Photo by Patrick Lohmann \/ Source NM)<\/figcaption><\/figure>\n\n\n\n<p>\u201cEverybody around here in this part of the country is armed,\u201d said Nancy Clopton, a longtime Hachita rancher with 80 square miles of leased pasture in and around the NDA. \u201cI don\u2019t want to be drug out of my pickup and then, you know, \u2018Oh, she\u2019s armed.\u2019\u201d<\/p>\n\n\n\n<p>The agreement allows ranchers to drive along access roads and county roads criss-crossing the NDA. Each time, they drive over cattleguards with new signs on either side that begin with, in English and Spanish: \u201cRestricted Area: This Department of Defense Property has been declared a restricted area by authority of the commander.\u201d&nbsp;<\/p>\n\n\n\n<p>About a dozen such signs are posted on cattleguards off Highway 9 between Sunland Park and Hachita, according to Source\u2019s count Sunday. Those are the same signs prosecutors use to justify criminal charges against the 550 defendants facing the unauthorized entry charges so far.&nbsp;<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>Everybody around here in this part of the country is armed. He also noted the land order that enabled the transfer was \u201csubject to valid existing rights,\u201d so he said the private \u201cproperty owners\u201d with land adjacent to the NDA would not be affected. But he did not immediately respond to a request for comment about how that applies to ranchers who lease, not own, land in the area.<\/p>\n\n\n\n<p>Bronson Corn, president of the NM Cattlegrowers Association, defended the arrangement in an interview with Source on Thursday.<\/p>\n\n\n\n<p>He disagrees with the idea that ranchers might be skirting the law, saying, albeit informal, the agreement allows ranchers to keep their cattle alive and maintain their leases with the BLM, while also allowing the Army to harden the border.<\/p>\n\n\n\n<p>\u201cThey have not had any conflicts with the military when it comes to being able to continue on with their day-to-day operations,\u201d he said. \u201cThere is some concern, there\u2019s no doubt about it, that they can\u2019t get to certain areas of their ranch due to the fact of that militarized zone.\u201d<\/p>\n\n\n\n<p>In addition to concerns about firearms, Clopton said she is concerned an influx of army personnel, potentially from out-of-state, won\u2019t be careful to close cattle gates behind them, which is a long-standing gripe she and other ranchers have with the Border Patrol. But she is withholding judgment, for now.<\/p>\n\n\n\n<p>\u201cWe\u2019ll see how it works out,\u201d she said. \u201cIt depends on the individuals on the ground, those individual soldiers, how they treat us, how we see them.
