Since President Donald Trump\u2019s inauguration in January, she has worried that the legal protections for her care in New Mexico \u2014 often described as a <a href=\"https:\/\/www.aclu-nm.org\/en\/know-your-rights\/know-your-lgbtq-rights\">safe haven<\/a> for LGBTQ+ people \u2014 might not last amid presidential executive orders that <a href=\"https:\/\/www.newsfromthestates.com\/article\/trump-signs-executive-order-banning-transgender-athletes-womens-school-sports\">target<\/a> transgender rights.<\/p>\n\n\n\n<p>She\u2019s not the only one.<\/p>\n\n\n\n<p>\u201cPeople are really scared about losing their access to care,\u201d Adrien Lawyer, co-founder and executive director of the Albuquerque-based New Mexico Transgender Resource Center told Source. \u201cBut in New Mexico, that\u2019s very unlikely to happen.\u201d<\/p>\n\n\n\n<p>That\u2019s because the state created a legal framework well in advance of federal rollbacks of trans rights. But that hasn\u2019t stopped legal challenges here, nor fully assuaged the fears of people who consider the care lifesaving.<\/p>\n\n\n\n<p><strong>The care<\/strong><\/p>\n\n\n\n<p>Gender-affirming care typically includes medication and surgical options that help people feel more aligned with the gender they know themselves to be, according to Dr. Molly McClain, a physician who provides gender-affirming care in the state. Medications include ones to suspend puberty, as well as hormone therapy to initiate puberty aligned with someone\u2019s gender, McClain said. People 18 and older also have surgical options.<\/p>\n\n\n\n<p>\u201cThe very important thing for everyone to recognize is that the way that someone feels affirmed in their gender is really, really individually dependent,\u201d McClain said. \u201cSo not everybody needs to be on medications, not everybody needs to get surgery, and everyone has their own journey that they are embarking on.\u201d<\/p>\n\n\n\n<p>In New Mexico, most medical practices are doing their best to continue providing gender-affirming care while paying attention to the federal changes, McClain noted.<\/p>\n\n\n\n<p>\u201cI think we have a lot of protections here and a lot of support that kids in other states don\u2019t \u2014 a lot of people who see them and hear them and love them,\u201d McClain said.<\/p>\n\n\n\n<p><strong>The legal landscape<\/strong><\/p>\n\n\n\n<p>In 2023, Gov. Michelle Lujan Grisham signed the <a href=\"https:\/\/www.nmlegis.gov\/Sessions\/23%20Regular\/final\/HB0007.pdf\">Reproductive and Gender-Affirming Health Care Act<\/a> into law, which in part prohibits public bodies from restricting or discriminating against a person\u2019s right to access gender-affirming care. The act defines gender-affirming care broadly, according to Jazmyn Taitingfong, a reproductive rights and gender equity attorney with ACLU of New Mexico.<\/p>\n\n\n\n<p>\u201cIt\u2019s described as psychological, behavioral, surgical, pharmaceutical and medical care services and supplies to support a person\u2019s gender identity,\u201d Taitingfong said. \u201cSo that\u2019s a very wide definition, and that\u2019s on purpose so that it protects people from discrimination from public bodies.\u201d<\/p>\n\n\n\n<p>The same year, Lujan Grisham signed <a href=\"https:\/\/www.nmlegis.gov\/Sessions\/23%20Regular\/final\/SB0013.pdf\">protections<\/a> for reproductive and gender-affirming health care providers and patients into law, preventing public bodies from releasing information or using their resources to assist outside investigations that seek to impose civil or criminal liability on medical providers who provide this care in New Mexico.<\/p>\n\n\n\n<p>\u201cThe reason that is so important is that many people are being forced to flee their home state to get certain types of health care \u2014 mainly gender affirming care and abortion health care,\u201d Taitingfong said. \u201cAnd so that is a level of protection if people go back to their home state.\u201d<\/p>\n\n\n\n<p>After taking office in January, Trump signed an <a href=\"https:\/\/www.npr.org\/2025\/02\/07\/g-s1-46893\/trump-anti-trans-rights-executive-action-gender-ideology-confusion\">order<\/a> halting the use of federal funds for gender-affirming care for youth under 19 years old. While a federal court <a href=\"https:\/\/apnews.com\/article\/trump-transgender-gender-affirming-care-14ff427c42ac52e37305ae51fd5a66bb\">blocked<\/a> the other, <a href=\"https:\/\/www.npr.org\/sections\/shots-health-news\/2025\/03\/25\/nx-s1-5338757\/transgender-surgery-lurie-chicago-hospital\">NPR<\/a> reports some hospitals across the country have stopped performing gender-affirming surgeries and providing other care nonetheless.<\/p>\n\n\n\n<p>According to <a href=\"https:\/\/translegislation.com\/bills\/2025\/passed\">Trans Legislation Tracker<\/a>, eight anti-trans bills were introduced in the most recent legislative session, one of which would have largely prohibited health care providers from providing gender-affirming care to minors, and opened up doctors to liability. The New Mexico Attorney General\u2019s Office <a href=\"https:\/\/www.nmlegis.gov\/Sessions\/25%20Regular\/AgencyAnalysis\/HB0466_305.pdf\">commented that many of the provisions<\/a> of that bill may have been unconstitutional.<\/p>\n\n\n\n<p>Ultimately, none of the bills made it through the legislative session.<\/p>\n\n\n\n<p>New Mexico\u2019s protections have been long in coming, Lawyer said, noting that LGBTQ+ advocates have worked for decades to create statewide protections.<\/p>\n\n\n\n<p>\u201cWe\u2019ve had activists here for a long, long time \u2014 30 years \u2014 trying to proactively create a legislative climate at the state level that\u2019s incredibly protective, and it\u2019s worked,\u201d Lawyer said.<\/p>\n\n\n\n<p><strong>Fear persists<\/strong><\/p>\n\n\n\n<p>Despite the legal protections New Mexico offers, McClain said she worries about the impact of the federal climate on her trans patients and their families.<\/p>\n\n\n\n<p>\u201cWhat I\u2019m seeing for all of these families is just a much higher level of stress and of fear,\u201d McClain said. \u201cI think we\u2019re going to see a huge uptick in all the things that make trans and nonbinary kids sick already.\u201d<\/p>\n\n\n\n<figure class=\"wp-block-image size-large\"><img loading=\"lazy\" decoding=\"async\" width=\"1024\" height=\"576\" src=\"https:\/\/www.newmexicopbs.org\/productions\/newmexicoinfocus\/wp-content\/uploads\/2025\/03\/Heather-Johnson-1024x576.jpg\" alt=\"Person with long hair and glasses smiling, standing outdoors near a green shrub and window.\" class=\"wp-image-46688\" srcset=\"https:\/\/www.newmexicopbs.org\/productions\/newmexicoinfocus\/wp-content\/uploads\/2025\/03\/Heather-Johnson-1024x576.jpg 1024w, https:\/\/www.newmexicopbs.org\/productions\/newmexicoinfocus\/wp-content\/uploads\/2025\/03\/Heather-Johnson-300x169.jpg 300w, https:\/\/www.newmexicopbs.org\/productions\/newmexicoinfocus\/wp-content\/uploads\/2025\/03\/Heather-Johnson-1536x864.jpg 1536w, https:\/\/www.newmexicopbs.org\/productions\/newmexicoinfocus\/wp-content\/uploads\/2025\/03\/Heather-Johnson-24x14.jpg 24w, https:\/\/www.newmexicopbs.org\/productions\/newmexicoinfocus\/wp-content\/uploads\/2025\/03\/Heather-Johnson-36x20.jpg 36w, https:\/\/www.newmexicopbs.org\/productions\/newmexicoinfocus\/wp-content\/uploads\/2025\/03\/Heather-Johnson-48x27.jpg 48w, https:\/\/www.newmexicopbs.org\/productions\/newmexicoinfocus\/wp-content\/uploads\/2025\/03\/Heather-Johnson.jpg 1920w\" sizes=\"auto, (max-width: 1024px) 100vw, 1024px\" \/><figcaption class=\"wp-element-caption\">UNM senior Heather Johnson says her gender-affirming care has allowed her to live a life that feels normal. (Photo\/Lily Alexander)<\/figcaption><\/figure>\n\n\n\n<p>Heather Johnson, also a trans senior at UNM, said she is concerned about the future of insurance coverage for hormone therapy. Earlier this month, the Centers for Medicare &amp; Medicaid Services released a <a href=\"https:\/\/www.cms.gov\/files\/document\/MarketplacePIRule2025.pdf\">proposed rule<\/a> that would prohibit individual and small business health insurance plans under the Affordable Care Act from covering gender-affirming care as an essential health benefit, according to <a href=\"https:\/\/www.kff.org\/private-insurance\/issue-brief\/new-rule-proposes-changes-to-aca-coverage-of-gender-affirming-care-potentially-increasing-costs-for-consumers\/\">KFF<\/a>.<\/p>\n\n\n\n<p>\u201cAs soon as insurance denies it, it\u2019ll at least triple in price,\u201d Johnson said. \u201cA lot of this stuff is rather expensive, and insurance takes care of a fair amount of it. And so the real fear is that we\u2019ll just be priced out of the medication we need to live.\u201d<\/p>\n\n\n\n<p>Johnson said the care allowed her to live a life that feels normal.<\/p>\n\n\n\n<p>\u201cIt\u2019s legitimately a life-saving care,\u201d she said. \u201cWithout it, I wouldn\u2019t be here, I guarantee that.\u201d<\/p>\n\n\n\n<p>For Pucella, access to hormone therapy allowed her to become a full version of herself.
