\n\t\tNew Mexico officials say PFAS court decision infringes on state’s rights\n\t<\/h1>\n\t

This week, the state of New Mexico\u00a0is\u00a0attempting a\u00a0new\u00a0legal\u00a0tactic\u00a0to\u00a0force the military to\u00a0clean up the PFAS, or\u00a0per- and polyfluoroalkyl substances, that have\u00a0polluted\u00a0waters\u00a0below\u00a0two New Mexico communities.\u00a0\u00a0<\/p>\n

In a\u00a0writ of mandamus<\/a>\u00a0filed on Monday,\u00a0New Mexico state\u00a0officials\u00a0attempt to\u00a0bring the legal battle over\u00a0PFAS\u00a0home-and they’re\u00a0challenging an earlier court decision\u00a0that\u00a0the state says\u00a0took\u00a0away\u00a0its\u00a0environmental policing powers.\u00a0<\/p>\n

After learning that activities at Cannon and Holloman Air Force bases had contaminated groundwater with\u00a0high levels of the toxic\u00a0chemicals\u00a0– which have been linked to myriad health problems, including developmental and immune system problems, liver and kidney disease, and cancer\u00a0– the\u00a0state of New Mexico\u00a0said the military violated its state\u00a0hazardous waste\u00a0permit.\u00a0\u00a0<\/p>\n

But the\u00a0military\u00a0sued the state, challenging\u00a0New Mexico’s regulatory\u00a0authority.\u00a0In turn, the\u00a0state filed its own\u00a0lawsuit,\u00a0asking a federal judge to compel the\u00a0U.S. Department of Defense (DOD)\u00a0to act on, and fund, cleanup\u00a0of the toxic plumes.\u00a0\u00a0<\/p>\n

“There is nothing more frustrating than knowing that people in New Mexico communities are exposed to these chemicals and the entity that caused it is doing nothing to address it,” says New Mexico Environment Department Secretary James Kenney. “That frustration was compounded when our litigation – meant to compel the DOD to expeditiously address this public health threat – was lumped in with slow-moving multidistrict litigation across the country.”\u00a0<\/p>\n

In\u00a02019, the\u00a0state’s case against the military\u00a0was moved to multidistrict litigation and a court in South Carolina. That one court is\u00a0overseeing all cases regarding PFAS and the military’s use of the polluting firefighting foams-more than\u00a0750 separate\u00a0actions.\u00a0\u00a0<\/p>\n

New Mexico\u00a0has already\u00a0tried to\u00a0extricate itself<\/a>\u00a0from the multidistrict litigation, hoping to\u00a0pursue its case against the Air Force without being\u00a0tied to those\u00a0hundreds of other cases.\u00a0\u00a0\u00a0<\/p>\n

But last year, United States District Judge Mark Gergel\u00a0denied\u00a0New Mexico’s\u00a0request, siding instead\u00a0with the Air Force, the U.S. government, the Defense Coordination Committee, and the Plaintiffs’ Executive Committee.\u00a0According to Gergel’s order<\/a>, “resolution of the issues raised [by New Mexico] is premature and it could prejudice other cases involving the same issues.”\u00a0\u00a0\u00a0<\/p>\n

Now, New Mexico is asking the\u00a0U.S. Court of Appeals for the Fourth District to overturn Gergel’s decision and remand the matter back to the District of New Mexico.\u00a0\u00a0<\/p>\n

According to a press release from the state, Gergel’s action was an “unconstitutional violation of New Mexico’s sovereignty” that will delay the case and put public health and the environment at further risk.\u00a0<\/p>\n

In other words, by keeping the case tied up in South Carolina, the court\u00a0is\u00a0interfering with state sovereignty.\u00a0\u00a0<\/p>\n

“Dislodging our suit from the multidistrict litigation will allow us to move swiftly in addressing these contaminants as the imminent and substantial public dangers they are,” Kenney says.\u00a0\u00a0\u00a0<\/p>\n

Military’s ‘shocking’ levels of PFAS<\/b>\u00a0<\/h3>\n

 <\/p>\n

Currently, the U.S. Environmental Protection Agency’s lifetime health advisory for two\u00a0of the\u00a0types of PFAS found at the bases is 70 parts per trillion. In the waters below Cannon, PFAS levels were more than 370 times the EPA’s lifetime limit. And at Holloman, PFAS levels were more than 27,000 times the lifetime limit-or 1,294,000 parts per trillion.\u00a0\u00a0\u00a0<\/p>\n

The Pentagon is also\u00a0supposed to be investigating<\/a>\u00a0whether PFAS\u00a0have leaked\u00a0from five other military installations in the state, including Fort Wingate, the Army National Guard armories in Rio Rancho and Roswell, the Army Aviation Support Facility in Santa Fe, and White Sands Missile Range.\u00a0Last month, the U.S. Geological Survey and\u00a0NMED\u00a0also\u00a0released a\u00a0study showing PFAS levels<\/a>\u00a0in\u00a0waters\u00a0across New Mexico.\u00a0\u00a0<\/p>\n

According to the writ of mandamus, the state brought its lawsuit against the military under the state’s Hazardous Waste Act and the federal Resource Conservation and Recovery Act, which delegates authority to states-and allows them to\u00a0regulate\u00a0hazardous waste.\u00a0Under that federal law<\/a>, “states issue permits to ensure compliance with\u00a0EPA\u00a0and state regulations.”\u00a0\u00a0<\/p>\n

The state calls the levels of PFAS at Cannon and Holloman “dangerous” and “shocking.”\u00a0The toxic chemicals have already migrated offsite to public and private wells that\u00a0provide\u00a0drinking water, irrigation water, and water for livestock, including at dairy farms.\u00a0A delay in the lawsuit, according to the state, means that contamination won’t just remain-it will worsen.\u00a0\u00a0<\/p>\n

Moreover,\u00a0the state asserts that\u00a0even though\u00a0the\u00a0military has acknowledged that the PFAS contamination is\u00a0from\u00a0its use of\u00a0PFAS-containing\u00a0firefighting foams, it\u00a0has failed to act on cleanup, cooperate with the state, or comply with\u00a0state and federal\u00a0pollution laws.\u00a0According to the state’s writ of mandamus, the military has also\u00a0refused\u00a0to share information “regarding the full nature and extent of this problem.”\u00a0<\/p>\n

“We are pursuing this petition because we strongly believe that coming from another sovereign government, the State’s claims against the federal government are unique and should not be adjudicated as though they were simply another civil lawsuit,”\u00a0according to an emailed comment from\u00a0Matt Baca, chief counsel for the\u00a0New Mexico Office of the Attorney General, which represents NMED in its case.\u00a0<\/p>\n

Kenney adds that the Biden administration has the chance to “change course” in how it treats communities suffering from PFAS contamination\u00a0and says he’d welcome a phone call from Washington. But, he says, “Make no mistake:\u00a0I will not back\u00a0down,\u00a0and I will not give up.”\u00a0<\/p>\n\t
