\n\t\tNew Mexico to delineate PFAS contamination from two Air Force bases\n\t<\/h1>\n\t

Last week, the state of New Mexico\u00a0released a request for proposals<\/a>\u00a0on\u00a0a contract to investigate PFAS contamination from Cannon and Holloman Air Force bases.\u00a0\u00a0<\/p>\n

We mentioned these plans a while back,\u00a0after the New Mexico State Legislature allocated\u00a0$1 million to\u00a0study where PFAS pollution has spread\u00a0and\u00a0another $100,000<\/a>\u00a0to create and implement a well testing program in Curry and Roosevelt counties.\u00a0<\/p>\n

By\u00a0sampling public and private wells near both bases and drilling new\u00a0monitoring wells to collect and analyze groundwater and soil samples, the project will help the state understand where the pollution has spread and better predict how and where it\u2019s moving next.\u00a0\u00a0<\/p>\n

The RFP notes<\/a>: \u201cWith a continued lack of action from the U.S. Department of Defense (DoD), New Mexico,\u00a0through this RFP, is pursuing innovative environmental strategies to protect its citizens, which will\u00a0also support continued actions to compel the DoD to cover all costs associated with study and\u00a0remediation of its contamination.\u201d\u00a0<\/p>\n

Bloomberg Law<\/i>\u00a0reports today that \u201cmore state and federal action on PFAS in groundwater<\/a>\u00a0is likely under a Biden administration, but is also possible under another Trump administration.\u201d\u00a0\u00a0<\/p>\n

In Wisconsin, the Natural Resources Board has approved an emergency rule for treating PFAS contamination from firefighting foam testing facilities. If approved by the state\u00a0Legislature, the rule will\u00a0clarify and set standards\u00a0created under a 2019\u00a0bill which prohibited companies that\u00a0manufacture\u00a0firefighting\u00a0foams\u00a0containing\u00a0PFAS from testing their products without \u201cproper containment and treatment.\u201d\u00a0\u00a0<\/p>\n

According to a story in the\u00a0Milwaukee Journal Sentinel:<\/i><\/a>\u00a0\u00a0<\/p>\n

Darsi Foss, the administrator of the environmental management division for the DNR, said the rule recognizes the fact that proper disposal of PFAS needs to be standard because the chemicals can’t just be tossed in a bin and forgotten or washed away.\u00a0\u00a0\u00a0<\/p>\n

\u201cThe prohibitions established by this law recognize that our landfills, and especially our wastewater treatment systems are not designed to immobilize or destroy PFAS,\u201d she said. \u201cIt is a highly mobile substance that does not degrade in the environment.\u201d\u00a0<\/p>\n

Michigan Radio reports that PFOS\u2014perfluorooctanesulfonic\u00a0acid, one type of PFAS\u2014is showing up in fish\u00a0collected from 125 contaminated sites in the state.\u00a0The Michigan Department of Environment, Great Lakes, and Energy\u00a0tested\u00a0for 11 different\u00a0chemicals;\u00a0PFOS were found within 92% of the fish sampled.\u00a0According to the story:<\/a>\u00a0<\/p>\n

The highest concentration was 10,000 parts-per-billion in a fish caught near the former Wurtsmith Air Force Base in Oscoda.\u00a0<\/p>\n

The average concentration of PFOS in fish was 80 parts-per-billion.\u00a0<\/p>\n

\u00a0300 parts-per-billion triggers the \u201cDo Not Eat\u201d advisory.\u00a0\u00a0<\/p>\n

And…don\u2019t\u00a0eat the deer, muskrats, frogs, mollusks, turtles and crayfish near Oscoda Township, where former Wurtsmith Air Force Base caused widespread PFAS contamination.\u00a0With hunting season about to start,\u00a0the Michigan departments of Health and Human Services and Natural Resources are reminding people of the various Do Not Eat advisories that have been enacted<\/a>.\u00a0\u00a0<\/p>\n

In New York,\u00a0the Committee\u00a0to\u00a0Preserve the Finger Lakes\u00a0is\u00a0asking state officials to deny a permit application for a solid waste transfer station<\/a>.\u00a0The transfer station would hold up to 22 tons of garbage\u00a0but lacks the ability to remove\u00a0PFAS from the water that leaches out of the trash.\u00a0Opponents\u00a0fear PFAS could then reach nearby Cayuga Lake,\u00a0which supplies\u00a0drinking water\u00a0to\u00a040,000\u00a0to\u00a090,000 people, according to a story in the\u00a0Finger Lake Times<\/i>.\u00a0\u00a0<\/p>\n

In Fayetteville, North Carolina, PFAS has been found in 55 private drinking water wells\u201412 miles from the Chemours plant\u00a0that we\u2019ve mentioned in previous weekly dispatches.\u00a0Under a consent order with the state, the chemical manufacturer is required to test private wells for PFAS, including GenX, and reduce the amount of PFAS it\u00a0is\u00a0releasing into the air and water.\u00a0Chemours\u00a0manufactures GenX,\u00a0which is\u00a0used in\u00a0non-stick cookware,\u00a0and\u00a0also\u00a0generates other PFAS as part of its operations.\u00a0\u00a0<\/p>\n

According to the story in\u00a0The Fayetteville Observer<\/i><\/a>: \u201cEach time GenX or other compounds are found at certain levels, Chemours has to test wells that are a fourth of a mile farther from the plant.\u201d\u00a0<\/p>\n

In California, the Santa Clarita Valley Water Agency sued a dozen companies, including Raytheon Technologies, Chemours, DuPont and 3M Co., for their role in introducing PFAS into the water supply.\u00a0\u00a0As Tammy\u00a0Murga\u00a0reports in\u00a0The Signal<\/i>:\u00a0<\/p>\n

The lawsuit alleges that the companies have known \u201cfor decades\u201d the dangers of PFAS and failed to provide a warning on the effects they have on human health and the environment.\u00a0\u00a0<\/p>\n

\u00a0\u201c(The companies) sold their products anyway,\u201d Scott Summy, a shareholder from Baron & Budd P.C., the law firm representing SCV Water, said in a statement. \u201cAs a result, many water providers have to now deal with the resulting problems. These cases are intended to shift some of the responsibility for paying for the costs of dealing with these contaminants away from the ratepayers and onto the responsible parties.\u201d\u00a0<\/p>\n

\u00a0Officials with DuPont and 3M said in emails to\u00a0The Signal\u00a0<\/i>Thursday they are \u201cvigorously defending\u201d their positions that they acted responsibly.\u00a0<\/p>\n

Taking a look\u00a0at that lawsuit,\u00a0The\u00a0<\/i>National Law Review<\/i><\/a>\u00a0notes that as states set drinking water limits for PFAS\u2014which the federal government has so far failed to do\u2014more utilities will try to figure out how to comply with those limits.\u00a0\u00a0<\/p>\n

A new, peer-reviewed paper in\u00a0The Journal of Clinical Endocrinology and Metabolism<\/i>\u00a0studied hundreds of women exposed to\u00a0PFAS when they\u00a0were\u00a0pregnant<\/a>\u00a0and found they\u00a0have a higher risk for poor cardiometabolic health\u00a0three years later.\u00a0\u00a0<\/p>\n

And at\u00a0The Conversation, North Carolina State University\u2019s Carol Kwiatkowski<\/a>\u00a0writes about a strategy for protecting the public from PFAS:\u00a0that is, reducing PFAS risks at their\u00a0source.\u00a0\u00a0<\/p>\n
